These Terms of Service ("Terms") govern your use of the Gomery online store and any purchase you make from us. By accessing the site or placing an order, you agree to these Terms. If you do not agree, please do not use the store.
1. Who we are
Gomery operates this store for the sale of consumer gadgets and everyday tech products, primarily to customers in Portugal and the European Union. Contact details are available on our Contact page.
2. Eligibility
You must be at least 18 years old (or the age of legal majority in your country) to place an order. By ordering, you confirm that the information you provide is accurate and complete.
3. Products and pricing
We try to display products, prices, and availability accurately. Prices are shown in the currency indicated at checkout and include VAT where required for EU consumers, unless stated otherwise. We may correct errors and refuse or cancel orders placed at an incorrect price. Product images are illustrative; slight differences in color or packaging can occur.
4. Orders and contract formation
Submitting an order is an offer to buy. We accept the offer when we send an order confirmation email. We may refuse or cancel an order for reasons including stock issues, pricing errors, suspected fraud, or shipping restrictions. If we cancel after payment, we will refund you.
5. Payment
Payment is due at checkout through the methods we offer (for example card or other Shopify-supported methods). You authorize the charge for the total amount shown, including shipping and taxes as applicable.
6. Shipping, returns, and privacy
Deliveries are governed by our Shipping Policy. Returns and refunds are governed by our Refund Policy. Personal data is handled as described in our Privacy Policy. Those policies form part of these Terms.
7. Intellectual property
All content on this store (text, graphics, logos, product descriptions, and design) is owned by Gomery or our licensors and is protected by intellectual property laws. You may not copy, scrape, or commercially reuse our content without prior written permission.
8. Acceptable use
You agree not to misuse the store, attempt unauthorized access, interfere with security, submit malware, or use the site for unlawful purposes. We may suspend access if we reasonably believe these Terms have been breached.
9. Disclaimer and limitation of liability
To the fullest extent permitted by law, the store and products are provided on an "as available" basis. Nothing in these Terms excludes or limits liability that cannot be excluded under Portuguese or EU consumer law, including liability for death or personal injury caused by negligence, or for fraud.
Subject to the above, we are not liable for indirect or consequential losses, loss of profits, or delays caused by events outside our reasonable control. Our total liability related to any order is limited to the amount you paid for that order, except where mandatory law provides otherwise.
10. Statutory consumer rights
If you buy as a consumer in the EU or Portugal, nothing in these Terms reduces your mandatory statutory rights, including the right of withdrawal and rights regarding defective goods.
11. Governing law and disputes
These Terms are governed by the laws of Portugal, without prejudice to mandatory consumer protections in your country of residence. EU consumers may also use the European Commission Online Dispute Resolution platform. Courts in Portugal have jurisdiction, unless mandatory rules give you the right to sue in your home courts.
12. Changes
We may update these Terms from time to time. The updated version will be posted on this page with a new "Last updated" date. Material changes may also be highlighted on the store. Continued use after changes constitutes acceptance of the updated Terms.
